On February 28, 2014, EMP partner Helen Parsonage learned that the US Attorney’s office has withdrawn its opposition to her Motion to Vacate a client’s conviction. Ms. Parsonage moved to vacate the federal conviction for possession of a firearm by a convicted felon on the basis that there was, in fact, no qualifying felony conviction in light of the Fourth Circuit’s decision in United States v. Simmons. The Government initially opposed, but has now withdrawn the opposition. EMP anticipates a favorable judgment from the court in the near future.
